Terms of Service
Last updated: [DATE]
1. Acceptance of Terms
By creating an account or using TrendsEngine ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
TrendsEngine is a sports statistics and market-data analytics platform. The Service provides historical performance trends, price comparisons across publicly available sports data feeds, and personal tracking/journaling features. The Service does NOT facilitate wagering, does NOT accept or hold funds for betting purposes, does NOT place bets or wagers on behalf of any user, and is NOT a sportsbook, betting exchange, or gambling operator of any kind. Results shown in My entries are records of what you entered; we do not verify wagers placed elsewhere. Where daily prices are not yet running, the pricing tools show sample or previously saved prices, labelled as such.
3. Eligibility and Where the Service Is Available
- You must be at least 19 years old if you live in Canada, or at least 21 years old if you live in the United States, or the age of majority where you live if that is higher.
- The Service is offered only to people who live in the provinces and states listed below. You must tell us truthfully where you live, and update it in Settings if it changes. Using the Service while living anywhere else is not allowed.
- Some tools are offered only in some places. The pricing-comparison tools (Positive EV, Arbitrage and the position-sizing calculator) are offered only where online sports betting with licensed sportsbooks is legal. In the places listed under "Statistics tools", the Service includes everything except those tools.
- You are responsible for following the laws where you live. If you choose to place a wager anywhere, use only sportsbooks licensed where you are. The Service never links to sportsbooks and is not paid by any of them.
- Which places and tools we offer reflects our own good-faith reading of local laws, which can change. Offering a tool in a place is not legal advice and is not a statement that using it, or betting, is lawful for you.
- We may add or remove places, or tools in a place, when laws change. If a change removes something you pay for, you may cancel and we refund unused prepaid time.
- By using the Service, you represent that you meet these requirements. The Service is not directed at, and must not be used by, anyone under the age above.
Every tool: Canada: Ontario. United States: Illinois, Indiana, Kansas, Maryland, Massachusetts, Michigan, New Jersey, New York, North Carolina, Ohio, Pennsylvania, Tennessee, Vermont, West Virginia.
Statistics tools (Trends, Movers, Injury Report, Fantasy and the Tracking Calendar): United States: Arizona, Arkansas, California, Colorado, District of Columbia, Florida, Iowa, Kentucky, Louisiana, Maine, Missouri, Nevada, New Hampshire, Oregon, Rhode Island, Virginia, Wyoming.
The Service is not offered anywhere else yet, including Quebec.
4. No Financial, Betting, or Investment Advice
Nothing on the Service constitutes financial, investment, or betting advice. All statistical data, trend information, market pricing analysis, projections, and calculations are provided for informational purposes only. Any decision a user makes based on information from the Service — including any wagering decisions made elsewhere, on third-party platforms — is made entirely at the user's own discretion and risk.
5. No Guaranteed Outcomes
Statistical calculations, including pricing-discrepancy identification and trend data, reflect historical data and mathematical calculations. They do not guarantee any future outcome. Past performance of any statistical pattern does not guarantee future results.
6. Subscription & Billing
- Prices are in Canadian dollars and shown before any applicable taxes. If your card is in another currency, your card issuer converts the charge and may add its own fee.
- The Service is offered on a recurring subscription basis at the price displayed at signup.
- Founding-member pricing applies to your subscription for as long as it remains continuously active and is lost if the subscription ends. Otherwise the price is the one displayed at signup.
- Subscriptions automatically renew each billing period until cancelled by the user.
- Payment is processed by Stripe and is subject to their terms as well.
- Price changes will be communicated to subscribers at least 30 days in advance. The founding-member price does not change while the subscription stays continuously active.
7. Cancellation & Refund Policy
- Users may cancel at any time through account settings; cancellation takes effect at the end of the current billing period.
- Refunds: payments are final, so we don't refund a payment because you changed your mind or didn't use Pro. Please try the Free plan first (no payment card needed), and cancel any time to stop the next charge. We do refund in these cases: (a) Billing errors: a duplicate charge, wrong amount or a charge after you cancelled is refunded in full. (b) A problem on our side: if a fault on our side (for example, you cannot sign in, or Pro shows as Free although you paid) stops Pro from working for you and we haven't fixed it within 3 days of you telling us at [email protected], we refund the payment for the month in which the fault began. (c) If we end the service, we refund unused prepaid time. (d) Nothing on this page limits any right you have under the consumer protection law of the province or state where you live.
- No trial: Pro is charged when you subscribe. You can try TrendsEngine on the Free plan, which needs no payment card.
- To request a refund or report a billing issue, contact [email protected].
8. Prohibited Use
Users may not: circumvent access controls or the paywall; scrape, resell, or redistribute data from the Service; use the Service unlawfully; interfere with security or infrastructure; misrepresent age or eligibility.
9. Intellectual Property
All content, design, software, and branding are the property of TrendsEngine and may not be copied or redistributed without permission.
You retain ownership of any information you enter into your account (such as watchlist selections or personal notes). By entering it, you grant us a limited licence to store, process, and display it back to you solely to operate the Service. If you send us feedback or suggestions, you agree we may use them without any obligation to you.
10. Disclaimer of Warranties
The Service and all data, statistics, and pricing comparisons within it are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any statistical data, trend, or pricing figure sourced from third-party feeds is complete, current, or free of error. You use the Service, and any information from it, at your own risk.
11. Third-Party Data & Services
The Service displays data drawn from third-party sports-data and odds providers and processes payments through a third-party payment processor. We do not control, and are not responsible for, the accuracy, availability, or terms of any third-party source, nor does referencing any sportsbook, league, team, or data provider imply that they endorse, sponsor, or are affiliated with TrendsEngine. Sportsbook, league, team and data-provider names are trademarks of their owners and are used only to identify them. Team names and colours are used only to identify teams. Illustrations are generic and are not official kits or merchandise, and they do not show team logos, crests, player numbers or the likeness of any real person.
12. Limitation of Liability
To the maximum extent permitted by law, TrendsEngine and its operator(s) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including financial losses arising from decisions made based on information from the Service, and any loss arising from using the Service where it is not offered or where using it is not lawful for you. Our total liability for any claim is limited to the greater of (a) what you paid us in the 12 months before the event that led to the claim and (b) C$100. This cap does not apply to refunds we owe you under section 7, or to our fraud or wilful misconduct. The Service is provided "as is," without warranties of any kind. Nothing in these Terms limits any right you have under the Consumer Protection Act, 2002 (Ontario), the consumer protection law of the place you live, or other law that cannot be waived.
13. Indemnification
You agree to indemnify and hold harmless TrendsEngine from third-party claims and reasonable expenses that arise because you broke these Terms or the law, including because you misstated your age or where you live. This does not apply to the extent we caused the loss, or where the law says you cannot be asked to cover it.
14. Force Majeure
We are not liable for any delay or failure to perform caused by events outside our reasonable control, including outages at our hosting, data, or payment providers, internet or power disruptions, natural disasters, labour disputes, or government action.
15. Account Termination
We reserve the right to suspend or terminate any account that violates these Terms, engages in fraud, or misuses the Service, with or without notice. If we end a paid account for a reason other than your breach, fraud or misuse, we refund unused prepaid time.
16. Changes to Terms
We may update these Terms. We give subscribers at least 30 days' notice of material changes by email or in-app notice, and you may cancel before they apply. Continued use after that date is acceptance.
17. Dispute Resolution
If you have a dispute with us, please contact [email protected] first and describe the issue; we will try in good faith to resolve it informally. If it isn't resolved within a reasonable time, either party may bring a claim in the courts of Ontario as described in the Governing Law section below (if you live in the United States, section 17A applies instead). Nothing in these Terms limits any right you have under the Consumer Protection Act, 2002 (Ontario) or the Class Proceedings Act, 1992, including the right to bring a claim in court or to start or join a class proceeding. If you live elsewhere in Canada, nothing in these Terms takes away a right that the law where you live says cannot be waived, including any right to bring a claim where you live.
17A. If You Live in the United States: Arbitration and Class-Action Waiver
This section applies only if you live in the United States. Please read it carefully: it affects how a dispute with us is resolved.
- Informal first. Before starting a claim, you and we will try to resolve the dispute informally for at least 60 days after one side emails the other a short description of the claim and what it wants (our address: [email protected]). The time limit for starting a claim is paused during that period.
- Small claims. Either side may instead bring an individual claim in small-claims court in the county where you live, if it qualifies.
- Individual arbitration. Otherwise, any dispute arising from these Terms or the Service will be resolved by final, binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules, by video or in the county where you live. The Federal Arbitration Act governs this section. We pay all arbitration filing, administration and arbitrator fees beyond what you would pay to file in court. If the arbitrator finds you brought the claim in bad faith or to harass us, fees may be shared only as far as the AAA Consumer Arbitration Rules allow. The arbitrator can award you the same individual relief a court could.
- No class actions. You and we may bring claims only individually, not as a plaintiff or class member in any class, collective or representative action (a lawsuit brought for a group), and an arbitrator may not combine the claims of more than one person.
- Many similar claims. If 25 or more similar arbitration demands are filed by or with the help of the same lawyers or organization, they are administered in batches of up to 25, with one arbitrator for each batch.
- Your right to opt out. You may opt out of this section by emailing us within 30 days of first accepting these Terms with the words "I opt out of arbitration". Opting out changes nothing else in these Terms.
- Nothing in this section takes away a right that the law where you live says cannot be waived, or stops you from reporting a concern to a government agency.
- If the class-action waiver cannot be enforced for a claim, that claim goes to court, not arbitration. If any other part of this section cannot be enforced, the rest still applies.
18. Governing Law
Governed by the laws of the Province of Ontario and applicable federal laws of Canada, except where the law of the place you live says its consumer protection rules apply and cannot be waived. If you live in Canada, either side may bring a claim in the courts of Ontario (subject to the rights described in section 17). If you live in the United States, section 17A applies.
19. General Provisions
- Severability: If any provision of these Terms is found unenforceable, the rest remain in full force and effect.
- Entire Agreement: These Terms, together with the Privacy Policy and Refund & Cancellation Policy, are the entire agreement between you and TrendsEngine regarding the Service, and replace any prior agreements on the same subject.
- No Waiver: If we don't enforce a provision right away, that doesn't mean we give up the right to enforce it later.
- Assignment: You may not transfer your account or these Terms to someone else. We may assign these Terms as part of a merger, acquisition, or sale of our business.
- No Partnership: Nothing in these Terms creates a partnership, joint venture, or agency relationship between you and TrendsEngine.
- Survival: Sections that by their nature should continue after your account ends — including Limitation of Liability, Indemnification, Intellectual Property, Dispute Resolution, Arbitration and Class-Action Waiver (17A), and Governing Law — remain in effect after termination.
